1. Acceptance of these terms

These Terms & Conditions govern your use of lovinglunchproject.org and any donation you make through it. By using this website or submitting a donation, you confirm that you are at least 18 years old, that you accept these terms, and that you have read our Privacy Policy. If you do not agree, please do not use the site.

2. Who you are transacting with

The Loving Lunch Project is the merchant of record for every donation made through this website. You are transacting with us directly and with no other party.

Our identity is shown on every page of this website, on the checkout page, on your emailed receipt and on your card statement, so that you can always tell who is receiving your donation.

3. Description of what we offer

The Loving Lunch Project provides free weekend and school-break meal kits to children in Iron County, Utah who are at risk of hunger when school meals are unavailable. Each kit contains shelf-stable breakfast, lunch and snack items for the days school is not in session, and is distributed discreetly to enrolled children through our partner schools.

The only transaction available on this website is a voluntary charitable donation toward that work, made either as a single gift or as a recurring monthly gift. We do not sell any product or service through this website. You receive no goods, services, membership, or other benefit in exchange for your donation.

4. Donation amounts and currency

5. No surcharges or added fees

We do not apply any surcharge, convenience fee, processing fee, service fee, shipping charge or tax to your donation. There is no minimum or maximum donation amount. The total charged is exactly the amount shown on the checkout page, and is identical whichever card or wallet you use — Visa, Mastercard or American Express, credit or debit, typed in or paid through Apple Pay or Google Pay. We never treat one card brand less favorably than another.

6. Monthly recurring donations

If you choose the monthly option you are authorizing a recurring charge. Please read this section and section 7 carefully before you donate.

  • Amount: the amount you select, in USD, including all charges. There are no additional fees or taxes.
  • Frequency: once every month, on or about the same day of the month as your first gift.
  • Duration: the donation continues until you cancel it. There is no fixed end date, no minimum number of payments and no cancellation fee.
  • Changes to the amount: the amount never changes unless you ask us to change it. We will never increase it on our own initiative.
  • Receipts: you receive an emailed receipt for every monthly charge, showing the amount, the date, the last four digits of the card charged, the date of your next gift, and a one-click link to cancel.

Before your first monthly gift is processed you must give separate, express consent to the recurring agreement by ticking the authorization box on the checkout page. That consent is distinct from your acceptance of these general terms. We retain a record of it for as long as the agreement remains in effect, and will provide a copy to you or to your card issuer on request.

7. Storing your card for monthly gifts

To process a recurring monthly donation, your card credential must be stored. This section explains that arrangement, as required by the Visa, Mastercard and American Express stored credential rules.

The first monthly charge is initiated by you. Subsequent monthly charges are initiated by us against the stored credential under this agreement, and are flagged to your bank as recurring stored-credential transactions so that your issuer can recognize them as authorized.

8. Cancellation policy

You may cancel a monthly donation at any time, immediately, with no explanation required and no fee. There is no notice period and no minimum term.

How to cancel

We will stop all future charges and send written confirmation within three business days. If a charge is taken after you asked us to cancel, we will refund it in full. A single donation that has not yet been processed can also be canceled the same way.

9. Refund and returns policy

Because no goods are sold or shipped, there is nothing to return. Charitable donations are generally non-refundable, as funds are committed quickly to purchasing food for children. That said, we never want anyone to be out of pocket because of a mistake:

10. How the charge appears on your statement

Donations made through this website will appear on your card statement as:

If you see a charge you do not recognize, please contact us before contacting your bank. We can usually identify and resolve it the same day.

11. Tax deductibility and receipts

The Loving Lunch Project is a tax-exempt organization under section 501(c)(3) of the Internal Revenue Code, EIN 41-4050082. Donations are tax deductible in the United States to the extent allowed by law. You receive no goods or services in exchange for your donation, so the full amount of your gift is generally deductible.

An emailed receipt is sent immediately for every donation, showing the amount in USD, the date, the last four digits of the card charged and our contact details. A consolidated year-end acknowledgement is available on request. We are not able to give tax advice; please consult your own tax advisor about your particular circumstances.

12. Delivery policy

No physical or digital goods are sold, shipped or delivered to donors. A donation is not a purchase, so there is nothing to ship and no delivery timeframe applies.

The only thing you receive is an emailed receipt, sent immediately after your donation is authorized, to the email address you provide. If it has not arrived within one hour, check your spam folder and then contact us and we will resend it.

The meals funded by your gift are distributed directly to participating children through our partner schools in Iron County, Utah, and are never shipped to donors.

13. Export and legal restrictions

Nothing is exported. All charitable activity funded through this website takes place entirely within Iron County, Utah, United States, and no goods cross any border.

Donations are accepted from within the United States. We may decline a donation from any jurisdiction where accepting it would place us in breach of United States law, including sanctions administered by the U.S. Treasury Department's Office of Foreign Assets Control. If you are donating from outside the United States, your card issuer may apply currency conversion or foreign transaction fees over which we have no control, and your gift may not be tax deductible in your country.

This website is intended for lawful charitable giving only. Our meal programs are operated in accordance with applicable federal, Utah state and Iron County requirements, and any volunteer role involving contact with children is subject to the screening required by us or by our school district partners.

14. Transaction security

Every page of this website, including the checkout page, is served over an encrypted HTTPS connection secured by a valid SSL/TLS certificate. You can confirm this by the padlock shown in your browser's address bar.

Card details are entered into secure fields hosted by our PCI DSS compliant payment gateway, not by us. If you pay with Apple Pay or Google Pay, your card number is never shared with us or with the gateway at all — the wallet supplies a one-time device-specific token instead. Those details are encrypted in your browser and exchanged directly with the gateway for a single-use token. Your full card number, expiration date and security code never pass through, and are never stored on, our own servers. Only the token reaches us, and it cannot be reversed into card details.

Our payment gateway and acquiring bank process card data as independent parties under their own security programs and under the operating rules of Visa, Mastercard and American Express. Further detail is in our Privacy Policy.

15. Volunteer sign-ups

Submitting a volunteer form is an expression of interest, not a binding commitment by you or by us, and involves no payment. Volunteer roles that involve contact with children are subject to any screening required by us or by our school district partners. We may decline or end a volunteer relationship at our discretion.

16. Acceptable use of this site

You agree not to use this website to submit false, fraudulent or unauthorized card details, to test stolen card numbers, to interfere with the operation or security of the site, to attempt to gain unauthorized access to any system, or to submit unlawful, abusive or misleading content through our forms. We may refuse, reverse or report any transaction we reasonably believe to be fraudulent.

17. Intellectual property

The Loving Lunch Project name, logo, text, photographs and page designs on this site belong to the Loving Lunch Project unless otherwise noted, and may not be reproduced for commercial purposes without our written permission. The Visa, Mastercard and American Express marks shown on this site are the property of their respective owners and are displayed solely to indicate the cards we accept.

18. Disclaimers and limitation of liability

This website and its content are provided on an "as is" and "as available" basis. We aim to keep the information accurate and the site available, but we do not warrant that it will be uninterrupted or error free. To the fullest extent permitted by law, the Loving Lunch Project is not liable for any indirect, incidental or consequential loss arising from your use of this website. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing here limits your rights against your card issuer.

19. Governing law

These Terms & Conditions are governed by the laws of the State of Utah, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Iron County or Washington County, Utah.

20. Changes to these terms

We may update these terms from time to time. The effective date at the top of this page shows when they were last revised. The terms in force at the time you make a donation are the terms that apply to that donation. If you have an active monthly donation, we will email you before any change to that agreement takes effect.
